These Terms and Conditions govern your use of adamspharmaceuticalservices.com and orders placed with ADAM'S PHARMACEUTICAL SERVICES PTY. LTD. (ABN 24 614 637 615), referred to as “we”, “us” or “our”. By using the website or placing an order, you agree to these terms.

These terms do not exclude, restrict or modify any guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

1. Eligibility and authority

You must have the legal capacity to enter a contract. If you order for a business or another person, you confirm that you are authorised to bind that entity or person and that the information supplied is accurate.

1. Accounts and guest checkout

You may shop as a guest or, where available, create an account. You are responsible for keeping your account credentials secure and for activity authorised through your account. Contact us promptly if you suspect unauthorised access.

We may suspend or close an account where reasonably necessary to protect customers, prevent fraud, comply with the law or respond to a material breach of these terms.

1. Product information

We take reasonable care to present accurate product descriptions, images, prices and availability. Packaging, colour and appearance may vary from images, and manufacturers may update labels or packaging. Read the current physical label and instructions before use.

Information on the website is general product information and is not medical advice, diagnosis or treatment. Follow product labels and warnings. Ask a pharmacist, doctor or other qualified health professional if you are unsure whether a health product is suitable for you, including if you are pregnant, breastfeeding, taking other medicines, have a medical condition or are purchasing for a child.

We do not offer prescription-only medicines for public online sale. Products that cannot lawfully be advertised or supplied through the public store must not be listed or made available for public purchase.

1. Prices, GST and delivery charges

Prices are in Australian dollars. Public retail prices include GST where GST applies. Delivery charges and any other applicable amounts will be shown before you confirm the order.

If a genuine pricing or description error is discovered before dispatch, we will contact you. You may confirm the corrected order or cancel the affected item for a refund. We will not substitute a product or increase an accepted price without your agreement.

1. Placing and accepting orders

Your checkout submission is an offer to buy. An automated acknowledgement confirms receipt of the order but does not necessarily mean the order has been accepted.

We may refuse or cancel an order before dispatch for legitimate reasons such as stock unavailability, suspected fraud, payment failure, an obvious error, delivery restrictions, unlawful supply or breach of these terms.

If we cancel an order after taking payment, we will refund the cancelled amount.

1. Payment

Available payment methods are displayed at checkout. Payment may be processed by independent providers under their terms. You confirm that you are authorised to use the selected payment method.

Cash on pickup is available only for eligible pickup orders. Payment in full is required when the order is collected.

1. Availability and quantity limits

Stock information may change. We may apply reasonable purchase limits to protect availability, comply with supply restrictions, prevent resale abuse or manage unusually large orders. We will contact you if an order cannot be fulfilled as submitted.

1. Delivery and pickup

Delivery and pickup are governed by our Shipping and Pickup Policy, which forms part of these terms. Delivery dates are estimates unless we expressly agree otherwise.

1. Returns and consumer guarantees

Returns and remedies are governed by our Refund and Returns Policy and the Australian Consumer Law.

Our 14-day change-of-mind offer is additional to, and does not replace, your legal rights.

1. Wholesale and trade customers

Approved wholesale or trade orders may be subject to separate account terms, minimum quantities, quoted freight, credit terms, invoices or written agreements.

If there is an inconsistency, the specifically agreed trade term applies to the trade order, subject to any law that cannot be excluded.

1. Promotions and discount codes

Promotions are subject to their stated terms, validity period, eligibility and stock availability.

Unless stated otherwise, one discount code may be used per order and codes cannot be exchanged for cash. We may correct misuse, technical errors or fraud in a reasonable and lawful manner.

1. Acceptable website use

You must not:

• Misuse the website
• Interfere with its security or operation
• Introduce malicious code
• Scrape or copy content unlawfully
• Attempt unauthorised access
• Impersonate another person
• Submit false or misleading information
• Use the website for unlawful or fraudulent activity

1. Intellectual property

The website and its original content, branding, graphics and layout are owned by or licensed to us and protected by applicable intellectual-property laws.

Product names and trade marks may belong to their respective owners. You may use the website for personal or authorised business purchasing but may not reproduce or exploit protected content without permission.

1. Third-party services and links

The website may use or link to third-party services, including Shopify, payment providers, delivery services and external websites. Their services may be governed by separate terms and privacy policies.

We are not responsible for third-party content or conduct beyond what the law makes us responsible for.

1. Website availability

We try to keep the website secure and available but do not guarantee uninterrupted or error-free access. We may maintain, update or suspend features where reasonably necessary.

This clause does not limit liability that cannot lawfully be limited.

1. Liability

To the maximum extent permitted by law, we are not liable for loss that was not reasonably foreseeable, was caused by your misuse or failure to follow instructions, or arose from events outside our reasonable control.

Nothing in these terms excludes liability or remedies that cannot lawfully be excluded.

1. Changes to these terms

We may update these terms for future use of the website or future orders.

The version applying to an order is the version available when the order is placed, unless a change is required by law or you agree to it.

1. Severability and waiver

If part of these terms is invalid or unenforceable, it will be read down or severed to the extent necessary without affecting the remaining terms.

A delay in enforcing a right is not a waiver of that right.

1. Governing law and contact

These terms are governed by the laws of New South Wales, Australia. You and we submit to the courts of New South Wales and courts entitled to hear appeals from them, subject to any mandatory consumer-law rights relating to jurisdiction.
